Terms of Service

These Terms of Service ("Terms") govern your use of the Softball AI Trainer mobile application (the "App"), the softballaitrainer.com website, and the parental-consent, support, and account-deletion services we provide through them (together, the "Service"), operated by BMD Labs LLC, an Ohio limited liability company ("we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Fitness and Training Disclaimer

Softball AI Trainer provides educational information about softball mechanics and training techniques. The App is not a substitute for professional coaching, medical advice, diagnosis, or physical therapy.

• Always consult a physician before beginning any new exercise program.
• Stop any drill or exercise immediately if you experience pain or discomfort.
• Users participate in recommended drills and exercises at their own risk.
• The App is not designed to diagnose, treat, or prevent any injury or medical condition.
• Supervision by a qualified adult is recommended for all youth athletes.

2. AI Coaching Disclaimer

Coach Jodi is an AI-powered coaching feature that provides informational guidance based on video analysis. Coach Jodi's feedback is generated by artificial intelligence and is not prescriptive medical or professional coaching advice.

• The accuracy of biomechanical analysis is not guaranteed. Results may vary based on video quality, camera angle, lighting, and other factors.
• AI-generated coaching suggestions should be reviewed by a qualified coach or trainer before implementation, especially for youth athletes.
• Coach Jodi's responses are generated by artificial intelligence provided by Anthropic (the company that makes Claude) and may occasionally contain inaccuracies.

3. Eligibility and Accounts

• You must be at least 13 years old to create an account. Children under 13 can never hold an account; they participate only as athlete profiles inside an account held by an adult (parent, legal guardian, or coach).
• Athlete profiles for children under 13 require a parent or legal guardian's consent before any analysis is run. A parent gives consent in the app; for coach-added athletes, the parent verifies control of their email address and gives consent on our website. Analysis is unavailable for an under-13 athlete until consent is granted.
• By creating an account, you represent that you are at least 13 years of age, and — if you add an athlete profile for a child — that you are that child's parent or legal guardian, or that you will obtain the parent's consent through the App's consent flow before use.
• You are responsible for maintaining the security of your account credentials.
• You agree to provide accurate information during registration and to keep your account information up to date.

4. Subscription Terms

• Softball AI Trainer offers a free tier with usage limits (such as weekly analysis and daily AI-coach limits and a saved-session cap), and paid subscriptions (Player and Coach tiers) that raise or remove those limits. On the free tier, saved sessions beyond the cap are automatically deleted, oldest first; if a paid subscription ends, sessions beyond the free-tier cap will likewise be deleted the next time an analysis is saved. Deleted sessions cannot be recovered.
• A free trial may be offered for paid tiers; trial terms are shown at purchase.
• Subscriptions auto-renew at the then-current price until you cancel. You can cancel at any time in Google Play → Payments & subscriptions; cancellation takes effect at the end of the current billing period, and you keep access until then. To avoid being charged when a free trial ends, cancel before the trial ends; if you cancel during a free trial, access to paid features may end immediately.
• Subscriptions are managed through Google Play. To cancel, go to your Google Play subscriptions settings.
• Refunds are subject to Google Play's refund policy.
• We reserve the right to change subscription pricing or free-tier limits with reasonable notice.

5. Advertising

The Service does not display advertisements and contains no advertising SDKs. If that ever changes, we will update these Terms and the Privacy Policy first, and notify existing users.

6. Acceptable Use

You agree not to:

• Upload or share inappropriate, offensive, or illegal content through the App
• Use the App for any purpose other than personal softball training and coaching
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Interfere with or disrupt the App's servers, services, or infrastructure
• Use the App to collect information about other users without their consent
• Share your account credentials with others

7. Intellectual Property

All content in the App, including but not limited to the analysis algorithms, biomechanical scoring systems, Coach Jodi AI responses, user interface design, graphics, and text, is the property of BMD Labs LLC and is protected by applicable intellectual property laws.

You retain ownership of any video or images you record. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial softball training and coaching in accordance with these Terms. By using the App, you grant us a limited license to process your video on-device, and to process text you submit to Coach Jodi through our service providers (including Anthropic), for the purpose of providing analysis and coaching services. We do not store, transmit, or claim ownership of your video content.

8. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind, express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or that analysis results will be accurate.
• In no event shall BMD Labs LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, loss of data, or loss of profits.
• Our total liability for any claim arising from your use of the App shall not exceed the greater of one hundred U.S. dollars (US $100) or the amount you paid for the App in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless BMD Labs LLC from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.

10. Termination

• You may stop using the App and delete your account at any time through App settings. Deleting your account does not cancel your subscription — subscriptions are billed by Google Play, so cancel in Google Play → Payments & subscriptions before deleting your account, or you will continue to be billed.
• We may suspend or terminate your account if you violate these Terms, with or without notice.
• Upon termination, your right to use the App ceases immediately. Local data on your device remains until you delete it.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Ohio.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting updated Terms in the App and updating the "Effective Date" above. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Severability; Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

These Terms, together with the Privacy Policy, constitute the entire agreement between you and BMD Labs LLC regarding the Service and supersede any prior agreements or communications about it.
